Jerry Underwood is Of-Counsel to Diefer Law Group, PC, lending his expertise of employment law on select cases.
Throughout his career, Jerry has represented his clients in every type of dispute imaginable between an employee and employer, including matters involving wrongful termination, retaliation, discrimination, harassment, breach of contract, and wage and hour disputes.
Jerry has litigated on behalf of his clients in federal and state courts, as well as arbitrations and mediations. Jerry also represents his clients before state and federal agencies, including the Department of Fair Employment and Housing, the Equal Employment Opportunity Commission, the California Labor Commissioner, U.S. Department of Labor, and certain matters before the Workers’ Compensation Appeals Board.
Jerry devotes a substantial portion of his practice to representing executives and professionals in transition, whether negotiating and drafting employment agreements, severance agreements, change of control agreements and, when necessary, advancing their interests in litigation or arbitration. Jerry has also represented executives, managers and employees when they are sued in their individual capacities in cases where ethical rules prevent one law firm from defending both the company and the individual. In such cases, Jerry is often retained to represent the individual and work cooperatively with the company's counsel to protect the individual's interests.
Jerry also has substantial experience in prosecuting and defending claims of unfair competition and trade secret disputes. Before establishing his own law office, Jerry was employed with the law firm of Stradling Yocca Carlson & Rauth in the employment law department in Newport Beach, and previously with Fisher & Phillips, a national employment law firm, in Irvine.
